Terms of Service
These Terms of Service ("Terms") are a binding agreement between you and [Your Company Name, LLC] ("Truckers Beam," "we," "us," or "our") and govern your use of the Truckers Beam application and website (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old and able to form a binding contract. If you use the Service on behalf of a business, you represent that you are authorized to bind that business to these Terms.
2. What Truckers Beam Is — and Isn't
Truckers Beam is a software tool that helps owner-operator truck drivers evaluate loads, organize documents, prepare broker communications, track business numbers, and manage compliance reminders. Truckers Beam is not a freight broker, dispatcher, factoring company, load board, carrier, insurer, accountant, or law firm, and does not arrange transportation, guarantee loads, or pay you. You are solely responsible for your business decisions and operations.
3. Your Account
You are responsible for the accuracy of your account information and for keeping your login credentials secure. You are responsible for activity under your account. Notify us promptly of any unauthorized use.
4. Your Content
You keep ownership of the loads, documents, figures, and other content you submit ("Your Content"). You grant us a limited, non-exclusive license to host, process, and display Your Content solely to operate and improve the Service, including processing it with the AI providers described in our Privacy Policy. You represent that you have the right to submit Your Content, including any documents that contain information about brokers or other third parties.
5. AI Features and Estimates
The Service uses artificial intelligence to read documents and generate estimates, audits, drafts, and assessments. These outputs are estimates and may contain errors. AI may misread a document, miscalculate, or produce inaccurate text. You are responsible for reviewing and verifying every output — including miles, rates, costs, profit estimates, load verdicts, audited rate confirmation terms, drafted messages, and compliance reminders — before relying on or acting on it.
6. Not Professional Advice
The Service does not provide financial, legal, tax, accounting, insurance, or regulatory advice, and using it does not create a professional relationship. Compliance reminders and document tracking are conveniences only; you remain solely responsible for your own DOT, FMCSA, IFTA, tax, and other legal obligations. Consult qualified professionals for advice about your situation.
7. No Earnings Guarantee
Any figures, examples, or projections shown — including sample income, take-home, cost-per-mile, or load profitability — are illustrative only and are not promises or guarantees of earnings. Your actual results depend on your own costs, lanes, miles, and decisions.
8. Acceptable Use
You agree not to: use the Service for any unlawful purpose; upload content you do not have the right to upload; misrepresent yourself; interfere with or attempt to breach the Service's security; scrape, reverse engineer, or copy the Service except as allowed by law; or use the Service to harm others.
9. Fees
The Service is currently offered free during an early-access period. We may introduce paid plans or features in the future. If we do, we will give you notice and you can choose whether to continue with any paid features.
10. Intellectual Property
We own the Service, including its software, design, brand, and name. We grant you a limited, revocable, non-transferable license to use the Service for your own business while you comply with these Terms. You may not use our name or marks without permission.
11. Third-Party Services
The Service relies on third parties (for example, our AI provider, database, and hosting providers). Their services may carry their own terms, and we are not responsible for third-party services or content.
12. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY OUTPUT WILL BE ACCURATE.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, TRUCKERS BEAM WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR [$100].
14. Indemnification
You agree to indemnify and hold harmless Truckers Beam from claims, losses, and expenses arising from Your Content, your use of the Service, or your violation of these Terms or of any law or third-party right.
15. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms or to protect the Service. Sections that by their nature should survive termination will survive.
16. Changes
We may modify the Service or these Terms. If we make material changes to these Terms, we will post the updated version and update the date above. Continued use after changes means you accept them.
17. Governing Law and Disputes
These Terms are governed by the laws of the State of [New York], without regard to its conflict-of-laws rules. Before filing any formal claim, you agree to first contact us and try to resolve the dispute informally for at least 30 days. Any unresolved dispute will be handled in the state or federal courts located in [New York], unless you and we agree otherwise. [If you want binding arbitration and a class-action waiver, your attorney should draft and add those clauses here.]
